"Laybourne. This the last Will and Testament of me Mary Laybourne of Beverley in the County of York Spinster (as follows) I Give devise and bequeath All my Freehold Messuages Cottages Closes Lands Tenements Hereditaments and Premisses Real and Personal Estate and Effects whatsoever and wheresoever I shall die possessed of with their and every of their Rights Members and Appurt[enance]s unto William Laybourn the Younger of Beverley aforesaid Gentleman Son of William Laybourn of Raysthorp in the County of York Gentleman and late a Lieutenant in the Twenty ninth Regiment of Foot and to his Heirs and Assigns for ever Subject to nevertheless and charged and chargeable with the payment of all my Debts Funeral Expences and the following Annuitys Legacys and Bequests hereinafter mentioned I Give and bequeath unto my Uncle William Huntington of Elloughton in the County of York Gentleman for and during the Term of his natural Life One Annuity or Yearly payment of Seven Pounds ten Shillings a Year, which added to an Annuity of Two Pounds ten Shillings a Year he is now intitled to from me for his Life will make together the Sum of Ten Pounds a Year to be paid to him by four equal Quarterly payments in every Year clear of all deductions the first payment to begin and be made at the end of three Calendar Months next after my decease I Give and bequeath to my Aunt Mary Huntington of the Town of Kingston upon Hull (the Widow and Relict of [blank] Huntington late of Kirk Ella in the County of York Clerk deceased) To Elizabeth Langdon, the Widow and Relict of [blank] Langdon late of Welton in the County of York Surgeon and Apothecary deceased, To [blank] Leybourne the Widow and Relict of William Leybourne late of Southwell in the County of Nottingham Clerk deceased To [blank] Leybourne Mother of the said William Leybourne Clerk deceased and to her two Daughters and to each and every of them respectively I Give and bequeath an Annuity or Yearly payment of Five Pounds each for and during their respective natural lives which said Annuities of five Pounds a Year to each of them the said Mary Huntington Elizabeth Langdon [blank] Leybourne the Widow of William Leybourne Clerk deceased [blank] Leybourne Mother of the said William Leybourne Clerk deceased and her two Daughters I direct to be paid to them and each of them respectively at two equal half Yearly payments in every Year clear of all deductions the first payments thereof to begin and be made at the end of Six Months next after my decease And in Case the said respective Annuitys or any part or parts thereof shall be behind or unpaid by the space of twenty Days next after any of the days of payment in the Year on which the same ought to be paid as aforesaid (being lawfully demanded) that then and so often it shall and may be lawful to and for all or any of the said Annuitants respectively during their and each of their respective natural lives into and upon the said Freehold Messuages Collages Closes Lands Tenements Hereditaments and Premisses hereinbefore devised to the said William Laybourn the Younger as aforesaid and which I do hereby charge with the payment of all the said Annuitys herein given and bequeath or any part thereof to enter and distrain for the same and the distress and distresses then and there found to detain and keep until the said Annuitants shall be fully paid and satisfied all such Arrearages with the Costs and Charges in and about the makeing and keeping thereof And in Case the said respective Annuitys or Yearly payments or any part or parts thereof shall be behind and unpaid by the space of forty Days next over or after any of the said Days of payment whereon the same ought to be paid as aforesaid that then and so often it shall and may be lawful to and for the said Annuitants respectively during their respective natural Lives into all and singular the same Premisses chargeable therewith as aforesaid or any part thereof to enter and to receive and take the Rents and Profits thereof until therewith or thereby or by the Person or Persons who shall be then intitled to the immediate Possession of the same Premisses they shall respectively be fully paid and satisfied the same and every part thereof and all arrears of the said respective Annuitys incurred before and which shall incurr during such time as they or any of them shall receive the Rents Issues and Profits thereof or be intitled to receive the same by virtue of such Entry to be made together with their respective Costs Charges and Expences laid out and Sustained by reason of the Nonpayment thereof or any part thereof I Give and bequeath to Bacchus Huntington of the Town of Kingston upon Hull Surgeon the Sum of Twenty Pounds I Give and bequeath to Olive Huntington his Sister of the same place Spinster my best Gown and best Suit of Lace I Give and bequeath to Izabella otherwise Bell Leybourne Sister to the said William Leybourne Clerk deceased Spinster my next best Gown and next best Suit of Lace And as to the rest of my Wearing Apparel I Give and bequeath the same to my Servant Elizabeth West Spinster And as to all the rest residue and remainder of my Real and Personal Estate and Effects my Debts funeral Expences Annuitys and Legacys hereinbefore mentioned being first paid I Give devise and bequeath the same and every part thereof unto the said William Laybourn the Younger Son of the said William Laybourn of Raysthorp aforesaid and late a Lieutenant in the Twenty ninth Regiment of Foot his Heirs and Assigns for ever And I do hereby nominate constitute and appoint the said William Laybourn the Younger Sole Executor of this my Will which I do hereby declare to be my last hereby revoking all former and other Wills by me at any time heretofore made declaring this only to be my last Will and Testament In Witness whereof I the said Mary Laybourne the Testatrix have to this my last Will contained in three Sheets of Paper to the two first of which I have set my Hand and to the third and last Sheet my hand and Seal this Twenty fifth day of February One thousand seven hundred and eighty four. Signed Sealed Published and declared by the said Testatrix Mary Laybourne as and for her last Will and Testament in the presence of us who in her presence at her request and in the presence of each other have Subscribed our Names as Witnesses hereto.
