Text | "Extracted from the Registry of the Exchequer Court of York. "This is the last Will and Testament of me Olive Huntington of Sculcoates in the County of York Spinster made and published this fifth day of February in the Year in the Year of our Lord one thousand eight hundred and twenty one I give and bequeath to my brothers William Huntington and Christopher Huntington each the sum of fifty pounds and to my servant Elizabeth Lilley the sum of ten pounds which said Legacies I direct to be paid to them respectively out of my personal Estate at the end of twelve Calendar Months next after my decease by my Executrix hereinafter named I give and bequeath as follows that is to say my Gold Watch and its appendages to my Nephew John Allanson Huntington my pair of Silver sauce Boats silver coffee pot and Diamond Ring to my Niece Elizabeth Dikes my Silver Tea pot and stand to my Nephew Frederick Huntington and the rest of my plate together with all my Household Furniture and wearing apparel to my Niece Mary Huntington my Executrix I give devise and bequeath all and every my Messuages Closes Lands and Hereditaments and parts and shares of Messuages Closes Lands and Hereditaments situate in the Lordship and parish of Cottingham in the said County of York and in the Town and County of Kingston upon Hull and all other my Real Estates whatsoever and wheresoever and likewise all my money and Securities for money Stocks Funds and all other my personal Estate and Effects of whatever nature or kind and whensoever the same is now is or are or shall be at the time of my death subject nevertheless as to my said personal Estate to the payment of my just debts Funeral and Testamentary Expenses and the three Legacies hereinbefore bequeathed to my said Brothers William and Christopher and the said Elizabeth Lilley unto my Sister Mary Tong and her assigns for and during the term of her natural life and from and immediately after the decease of her my said Sister I give devise and bequeath the said Real and personal Estates and every part thereof respectively unto and amongst my said Nieces Elizabeth Dikes and Mary Huntington and my said Nephews John Allanson Huntington and Frederick Huntington their respective Heirs Executors administrators and assigns in equal shares and to take as to my said Real Estate as Tenants in Common and not as joint Tenants I give and devise to the said Mary Tong and Mary Huntington and their Heirs and assigns all Lands Heredit[aments] and Real Estates now rested in me and my Heirs as Mortgage in fee or Trustee to the end and intent that when and as occasion shall require they the said Mary Tong and Mary Huntington or the Survivor of them or the Heirs of such Survivor may dispose of and convey such Lands Hereditaments and Real Estates according to the rules of Law and Equity without the aid or interference of my Heir at Law and Lastly I appoint the said Mary Huntington the sole Executrix of this my last Will and Testament and I revoke all former Wills by me made In witness whereof I the said Olive Huntington the Testatrix have to this my last Will and Testament comprized in two Sheets of paper set my hand and Seal that is to say to the first my hand and to this second and last Sheet my hand and Seal the day and year first before written Olive Huntington (LS) the preceding sheet was duly signed and this sheet duly signed and sealed and both duly published and declared by the said Testatrix as and for her last Will and Testament in the presence of us who at her request in her presence and in the presence of each other have subscribed our names as witnesses hereto Thos. "Proved at London 26th April 1826 before the Judge by the oath of Mary Huntington Spinster the Niece the sole Executrix to whom admon was granted having been first sworn by Commission duly to administer." | |
